SHOULD I GET A LAWYER OR NOT?

Hi streak, sorry havent been around in awhile but having bad pain in my mouth...again.
I had to have fillings and a root canal done not even a year ago. The pain continued and i called to let them know. I was told yes that happens with some of our patiants but should settle down in a few months. Well it didnt and it began to get worse so i made an emergency visit today and had exrays done. My dentist that did the work no longer works there so I had another who seems quite nice and explained to me while he pointed at the exray saying..that is NOT a root canal. He showed me the filling was left open by not going all the way up to the gum line making a pocket for debris. I now have an infection and have to have 2 root canals done next month. The one that was done must be redone correctly and is causing havok on the other one next to it. I am sooo pissed right now. Thats another 3000 i have to pay!! I just got done paying for the screwed up root canal..I also have to have it crowned. My sister said thats bullshit and THEY shouldnt charge me anything because it was the dentist screw up. She says I should sue. I have never sued anyone and hate to do that because this new dentist..My old dentist partner seems so concerned and willing to take time to listen and explain things when the other guy didnt. They wanted to charge me for the exray but then decided against it. What should I do???

wow, that doesnt sound good at all redfawn, but i dont know what the right thing to do is
I hope you get it figured out and start to feel better.

Sorry that you have so much pain redfawn, they are terrible when you have an infection in them, I have had that several times, I hope they the dentist gave you some antibiotics to clear that up before attempting to fix the root canal. Can't help about the suing thing, we actually don't do it much here in Aus like the states. Do you have a free legal aid service that you can ring and get advice?

Wow, sry redfawn you are having to go through this pain. Talk to legal aide and ask what they think. I personally would ask them first before anything. Ultimately, the choice whether to sue or not is yours. Hope your pain clears up soon for you.

Thats so messed up Redfawn! So sorry you are in pain and you have to go through 2 root canals again. I know first hand how very expensive dental work can be. You should not have to be paying for the same work twice!! I would speak to a lawyer and get some info for sure!

Thanks for the advice friends, I think I might call the business and tell them I feel this should be done free of charge
because i already paid for it. Or they can give me back my money and I will find another dentist.If they wont then next I will find Dr. Peterson and tell him I want my money back and if that doesnt work..I will get aid and see what can be done. So depressed..This stinks. I did get antibiotic and generic Lortabs(Vicodan) makes me sick as a dog ugh.. I will post more when i feel better..right now feeling bad. Thanks again!

There's nothing better than being able to share things like this with your friends, a few heads are better than none, glad we were hear to at least listen for you, and that you feel better soon, at least you have a plan now.

I have dealt with situations like this. If a dentist at the same office told you it was a botched job then they already know they are in the wrong. Also, they admitted they were wrong when they did'nt charge you for the x-ray. Nobody wants to get sued so try threats first. You have to calmly but firmly let them know that you expect them to make good on this. If they try to blow you off start mentioning words like BBB and attorney. I will be greatly surprized if they don't give in.
