Bad New York Child Support

Ok, I was receiving $400 a month in child support for my 12 year old son, so 9 weeks ago his father died suddenly, ChildSupport gets notified and stops all my payments till we all go in front of the Judge (by all I mean, myself representing my son, his oldest daughter who is 33, and his other son who is 22), to gather his assessts and crap. Now here is the kicker, every year his father would put is tax return into the pot down at Child Support so he was always ahead in his support about $4000 in case he ever missed a payment or whatever, now the Child Support Unit tells me this monies now becomes part of his estate and that it may have to be split with his older children. To say I am livid is a complete and utter understatement. That money that is sitting in Albany County Child Support is my sons and not only have I not received my last two months of child support now I find out I may have to split it with his adult child. Oh New York you are sooooooo trying my patience.....

OMG!! That is terrible! How can they do that?? Do his "ADULT" children really need it that bad?? To take it away from a child!

My heart goes out to you and your son!

Yes, I imagine it is frustrating, but you will be able to get Social Security for him at least hon.

Yes, he will get death benefits for the rest of his life because he is also disabled. But all this takes time, mean while my childsupport is not coming in, it is very frustrating waiting on courts, because he died so suddenly he had no will so all his assessts are now sitting waiting for a judge to decide what to do, I understand all this, but i want to say to Judge "that's all fine, but would mind telling my son he cannot go to camp this summer, he cannot get his new summer clothes, etc..." I have to cut alot of things out now, including special meals that my son and I go out to once a month, museum trips which he loves, and all kinds of little things and of course no casino playing.

I totally understand titanic, I went through the same thing when my boys were 12, 12 and 15. It will all work out, I swear. :)HG hang in there

Its absolutely ridiculous Titanic!! I am sorry you have to deal with this, it truly sucks. I would fight it every and any way you can! Tell his grown up children to back the heck off, this is a child and their brother!!!:hit

Ok first thank you for allowing me to vent my frustrations... I was on the edge yesterday got the letter from the lawyer and was livid. Just so you know I am not swimming in poverty lol, I do have a few dollars put away for certain things but was hoping not to touch that for years, but I guess in the name of my child eating, camping, etc... I will dip in, it is rainy day money and I guess it is raining now lolol.

Thank you again for the vent posts, things will be tight for awhile but my child will not starve, and I will not go w/o my cigs and coffee lol, I will go w/o casinos, I will not buy expensive batteries for my "little friend" lolol "you know ladies what I'm talking about", so you know all the little things that moms enjoy will be gone for a bit. lolol
